1. WHO MAY ENTER

To enter and be eligible to win, an entrant must be a legal resident of Canada and be of the age of majority in the province or territory in which he/she resides. Employees of, or those residing with an employee of Dr Pepper Snapple Group or Curves International Inc. ("Sponsors"), their agents, representatives, parents, affiliates, subsidiaries and dealers, advertising and promotional agencies, materials or services related to this contest, the independent judging organization, or members of their respective immediate families, are not eligible to enter this contest.

2. HOW TO ENTER

Void where prohibited. Limit of one (1) entry per household, per day, during the contest period. There are two (2) ways of entering this contest:

  1. You may enter online at www.welchspromotions.com. Follow the instructions to enter the contest. You will automatically receive one (1) entry into the contest.
  2. Legibly print your full name, complete address, including postal code, daytime telephone number with area code, and mail with sufficient postage to: Welch's Contest, P.O. Box 91039, Pickering, ON L1W 9Z9. Your mail-in entry must be postmarked on or before August 31, 2006 and received no later than 5:00 pm EST on September 8, 2006, otherwise the entry will be void. Upon receipt of your entry, you will be automatically entered into the contest.

Contest runs from 9:00 am (EST) April 1, 2006 to 5:00 pm (EST) August 31, 2006 (the "Contest Period").

3. PRIZES

There are a total of ten (10) prizes available to be won. Each prize consists of a one (1) year Fitness Membership at CurvesTM valid for one (1) year from the date of Membership signing at CurvesTM with no obligation past the one (1) year. Approximate retail value of the prize is $677.00 CAD. Odds of winning depend on number of entries received.

Prizes must be accepted as awarded without substitution and are not transferable, not for resale and have no cash surrender value. Sponsors reserve the right, in the event that a prize or any component of the prize cannot be awarded as described for any reason, to substitute another prize of equal or greater value, without liability.

4. THE DRAW

There will be ten (10) random draws on Friday, September 15th, 2006 at 10:00 am (EST) in Toronto, Ontario by the independent contest judging organization from all valid entries received online and by mail. Limit one prize per person or household.

Before being awarded a prize, potential winners will be required to correctly answer a time limited, mathematical skill-testing question to be administered by phone or mail and to sign and return within the time stipulated by Sponsors, a full declaration and release of liability form stating that he/she has read and understood these official rules and regulations, grants all consents and authorizes the Sponsors to broadcast, publish and disseminate his/her name, address, photograph, likeness, voice, in connection with any promotion or publicity, and/or general news, entertainment and information purposes relating to this Contest at no additional compensation to the potential winner, beyond the awarding of the Prize. Potential winner must also agree to accept the Prize as offered and release the Sponsors from any and all liability of any kind arising out of the potential winner's participation in this contest and receipt and use or misuse of the Prize. Sponsors or their agent will deliver the Prize to the confirmed winners within 30 days of receiving the completed forms. In the event that a potential winner does not comply with all the provisions as contemplated in these official rules and regulations, Sponsors shall have the right to disqualify the potential winner, and select an alternate potential winner and shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential winner, if applicable, shall be applied, with the necessary amendments, until a qualified winner has been duly selected.

5. GENERAL RULES

Limitation of Liability. Sponsors shall not be responsible for lost, stolen, delayed, damaged or misdirected claims or entries, or for any failure, or for any problems or technical malfunction of any internet or telephone network or broadcast transmission during the promotional period.

Without limiting the release of liability provisions herein, and for greater certainty, the Contest Entities (defined below) will not be liable for: a) any incorrect or inaccurate information, whether caused by contest website users or by any equipment or programming associated with or utilized in the contest or by any technical or human error which may occur in the processing of entries in the contest; b) any error, omission, interruption, deletion, defect or delay in operation of the contest website or any transmission in connection with the contest; c) any communications line failure, theft, destruction or unauthorized access to, or alteration of, entries; d) any problems with, or technical malfunction of, any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, or failure of e-mail which may occur for any reason whatsoever, including technical problems or traffic congestion on the Internet or at any website or combination thereof; or e) any injury or damage to entrants' or to any other person's computer related to or resulting from participating or downloading materials in this contest.

If the contest is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause of any nature whatsoever beyond the reasonable control of the Contest Entities which corrupt or affect the administration, security or proper conduct of this contest, Sponsors reserve the right, at their sole discretion, to, without advance notice, terminate or suspend the contest, in whole or in part, or modify it in any way, subject to the approval of the Regie des alcools, des courses et des jeux in respect of residents of Quebec.

Release of Liability. Sponsors accept no responsibility for loss, damage or claims caused by the awarded prizes or the contest itself. By entering, entrants release and hold harmless Sponsors, their affiliated and related companies and advertising, promotion agencies and all of their respective directors, officers, shareholders, employees, agents, successors and assigns (collectively, the "Contest Entities") from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the contest or any prize won. Winners will be required to sign and return, within the time period indicated on the documents, a declaration and compliance with contest rules and a full liability and publicity release and/or any other document.

Sportsmanship. Sponsors reserve the right, at their sole discretion, to disqualify any individual from the contest, and to ban that individual from any future promotion of Sponsors, if Sponsors find or believe such individual to be tampering with the entry process or the operation of the contest or, where applicable, the contest website; to be acting in violation of the contest rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass Sponsors, their agencies, other entrants or any other person. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

All contestants recognize the rules to be binding. All entries become the property of the Sponsors. No correspondence will be entered into except with potential prize winners. This contest is subject to all applicable laws and shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.

Disputes re E-mail Entries. In the event of a dispute as to who submitted an e-mail entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Selected entrants may be required to provide Sponsors with proof that he/she is the authorized account holder of the e-mail address associated with the selected entry.

Quebec residents may submit any dispute respecting the conduct and awarding of a prize in this contest to the Regie des alcools, des courses et des jeux du Quebec.

Privacy. Sponsors respect your right to privacy of your personal information. Please review their Privacy Policies for details on the manner in which they collect, use, disclose, and otherwise manage your personal information. Sponsors will not keep personal information for more than 12 months after the contest ends.
